Felony Flatulence
In South Charleston, West Virginia on September 23, 2008 a man was stopped for driving at night without his headlights on. Upon approaching the car he smelled a strong odor of alcohol coming from inside the car. The officer conducted field sobriety tests and noticed the man to be unsteady on his feet and slurred his words.
The person was then placed under arrest and brought to the police station. While attempting to fingerprint the accused and enter his information into the intoximeter breath machine the man scooted himself near the officer and lifted his leg and passed gas loudly. He then used his hand to fan the the air towards the officer. WSAZ.com Reported
According to the Criminal Complain, the officer stated that the gas was very odorous and found his contact to be of an insulting or provoking nature. In addition to the DUI he was also charged with Battery on a Police Officer. Although the Complaint makes reference to a felony it appears was charged with the lower offense of a misdemeanor.
The battery on an officer allegation clearly stinks and hopefully the prosecutor or court can see the truth to the battery charge and voluntarily dismisses that offense.
