Exonerating the Bond Video

Summary: What does it mean to exonerate the bond?

When the Court orders or declares the bond exonerated, the Court is basically issuing an order to clear the money or property put up as bond money, and return the item to the person who posted it and releasing the guarantee that the defendant will appear in court. The court is releasing the money or collateral.

This procedure normally occurs after a trial is completed, the matter resolved and the person no longer needs to attend court. Exoneration of the bond could proceed when the bond has revoked and the person charged is taken in custody awaiting trial. Exonerations customarily occur when the matter is decided, but can be done anytime the judge feels the bond is no longer necessary to assure the appearance by the defendant in court.

If you feel the bond is excessive a criminal defense attorney can file a motion to modify release conditions. The criminal lawyer is basically asking the court to reconsider the amount that it originally ordered due to a change of conditions or facts not originally known to the court at the time its decision was made.
