Divorce - Visitation Rights
When one parent (custodial) is awarded custody of the child, the other (non-custodial) parent is granted rights of visitation. Visitation is a factor in almost all custody arrangements unless it is deemed not in “a child’s best interest.”
The guidelines for visitation should be considered and ruled upon early. It is the responsibility of the parents to arrange for a reasonable schedule of visitation. If the parents can’t reach an agreement then the court will decide. This discussion should be approached by both parents to decide the issues of when, where, and for how long.
The child has a right to continue an ongoing relationship with both parents. Once arrangements have been made, they should not be deliberately interfered with.
Any temporary visitation arrangements made prior to the final divorce are not always the guidelines followed after the divorce.
