Understanding Divorce

Divorce is the state recognition that the marriage is void and no longer exists. All states have their own laws and procedural requirements to dissolve a marriage.

Some states require a “cooling off” period before you may finalize or begin the formal court proceedings. Also, some states require a hearing to establish misconduct on by one spouse. While other states require a separation degree to allow time to pass before the union formally dissolves.

Finally, other states have a “no fault” divorce where the court determines that the relationship is no longer viable, there is a breakdown in the marriage with no possibility of getting back together. Thus, the union is broken.

Again, all states have their own laws for the determination and approval of a divorce. Please consult with a divorce attorney in your state to learn more about the specific laws in your state.
